    • Provider retains all rights to WIN PC App including software, technology, code, algorithms, processes, and documentation. The MapCite IP-protected data analysis is proprietary and copyright-protected. You receive only a limited, non-exclusive, non-transferable license during your subscription.
  • Can I share the geospatial data with others?
    • No. Geospatial data is provided for your internal campaign use only. You cannot sell, license, distribute, or share it with any third party. Upon termination, you cannot retain copies except as embedded in historical campaign records for archival purposes only.
  • Who owns my campaign materials and data?
    • You retain all rights to your campaign materials, branding, content, and data uploaded to WIN PC App. Provider receives only a limited license to use your materials as necessary to provide services.

Dispute Resolution

  • How are disputes resolved?
    • Disputes follow a three-step process:
      • Informal negotiation – 30 days of good faith negotiations between senior executives
      • Mediation – JAMS mediation in Los Angeles County, California (costs split equally)
      • Binding arbitration – JAMS arbitration in Los Angeles County if mediation fails
  • Can I participate in a class action lawsuit?
    • No. The Agreement includes a class action waiver. All proceedings must be conducted on an individual basis, not as a class, consolidated, or representative action.
  • What law governs this Agreement?
    • The Agreement is governed by California law, and any legal proceedings are subject to the exclusive jurisdiction of courts in Los Angeles County, California (subject to arbitration requirements).

  • What information do I need to provide during setup?
    • You’ll need to provide:
      • Campaign information and branding materials
      • Administrator contact information
      • Common Sense Values Pledge acknowledgment
      • Donation portal link information
      • Territory specification for Geospatial Data Package (if selected)
  • How do I specify my geographic territory for data acquisition?
    • You’ll provide details including county/counties, district boundaries, state, and any additional territory specifications in the service agreement.
  • Is there training or onboarding support?
    • Yes, Provider sets up your account, configures your dashboard, provides onboarding documentation and training materials, and schedules an optional onboarding consultation call.
